These Terms and Conditions (“Terms”) govern your access to and use of the website operated by Nichols MFG, Inc. DBA The Gun Co. (“The Gun Co.,” “we,” “us,” or “our”), including thegunco.com, our online store, and related services collectively referred to as the “Site” or “Services.”
By accessing the Site, creating an account, submitting an order, purchasing merchandise, or otherwise using our Services, you agree to these Terms and any policies incorporated into them.
We may revise these Terms from time to time. The version posted on the Site at the time of your transaction will govern that transaction except where otherwise required by law.
1. Eligibility and Legal Compliance
You may use this Site only for lawful purposes.
You are responsible for determining whether you are legally permitted to purchase, possess, receive, install, transport, or use any product offered by The Gun Co. in your jurisdiction.
Firearms, serialized products, ammunition, magazines, firearm components, and other regulated products may be subject to federal, state, and local restrictions.
The Gun Co. reserves the right to refuse, cancel, or hold any order when necessary to comply with applicable law, licensing requirements, shipping restrictions, fraud-prevention procedures, or other regulatory requirements.
Firearms and other products requiring transfer through a Federal Firearms Licensee (“FFL”) will only be shipped or transferred in accordance with applicable law.
Submitting an order does not guarantee that the order can legally be fulfilled or transferred.
2. Product Compatibility and Installation
Products manufactured by The Gun Co. are designed for use with the firearm makes, models, generations, configurations, and components identified in the applicable product description.
Compatibility with modified firearms, aftermarket components, products from other manufacturers, or configurations not expressly identified by The Gun Co. is not guaranteed.
Unless expressly stated otherwise, firearm parts and components should be installed by a qualified gunsmith or appropriately trained armorer.
Following installation, the installer is responsible for performing all appropriate safety, fitment, function, and reliability checks before the firearm is placed into service.
Installation, modification, or use of a product contrary to its instructions, with an incompatible firearm or component, or in an unsafe or unlawful manner may result in product failure, firearm malfunction, property damage, serious injury, or death.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, pricing, compatibility information, and availability information are accurate.
However, minor variations may occur, particularly with colors, finishes, coatings, machining, custom products, manufacturer specifications, and products displayed on different monitors or devices.
Product images may be representative and may show configurations, accessories, finishes, or components that are not included with the purchased product.
If a material error affects an order, The Gun Co. may contact the customer to correct the order or may cancel and refund the affected portion of the order.
4. Order Acceptance
An order confirmation acknowledges that we received your order. It does not constitute final acceptance of the order.
The Gun Co. reserves the right to decline or cancel an order before fulfillment for reasons including:
- Product unavailability
- Pricing or listing errors
- Payment or fraud concerns
- Legal or regulatory restrictions
- Shipping restrictions
- Firearm-transfer requirements
- Customer eligibility
- Suspected unauthorized coupon or discount use
- Other circumstances that prevent lawful or commercially reasonable fulfillment
If we cancel an order that has already been charged and no cancellation fee lawfully applies, the applicable amount will be refunded to the original payment method.
5. Pricing, Payment, Promotions, and Discounts
Prices are shown in U.S. dollars unless otherwise stated.
Taxes, shipping, insurance, transfer fees, government fees, processing fees, and other applicable charges may be added during checkout or otherwise charged as required.
Promotional codes and discounts are subject to their stated eligibility requirements and limitations.
Unless expressly stated otherwise, discounts and promotional codes may not be combined.
Discount Eligibility for Custom and Third-Party Products
Custom products, custom builds, special-order products, and products not manufactured by The Gun Co., including certain optics, scopes, accessories, and third-party products, may be excluded from promotional discounts or coupon codes.
If a coupon or discount is applied to an ineligible product because of a website, checkout, or customer-entry error, The Gun Co. may:
- Cancel the affected order and issue the appropriate refund
- Contact the customer and provide an opportunity to pay the difference before fulfillment
Use of a promotional code does not create a right to receive a product at an incorrectly discounted price.
6. Order Cancellations
Please review your order carefully before submitting it, including product descriptions, compatibility information, specifications, quantities, shipping information, and firearm-transfer requirements.
6.1 24-Hour Cancellation Period
A standard stocked-product order may be canceled for a full refund if:
- The cancellation request is received within 24 hours after the order is placed
- The order has not shipped
Cancellation requests must include the customer’s name and order number and must be submitted to info@thegunco.com.
Once an order has shipped, it cannot be canceled and will instead be subject to the applicable return policy.
6.2 Cancellations After 24 Hours
A standard stocked-product order canceled more than 24 hours after the order was placed, but before it ships, is subject to a cancellation fee equal to 15% of the product purchase price, except where prohibited or limited by applicable law.
6.3 Custom, Special-Order, and Limited-Production Products
Custom products, custom builds, special-order products, limited-production products, and other products designated as final sale cannot be canceled once purchasing, allocation, customization, assembly, machining, coating, engraving, manufacturing, or other work on the order has begun.
6.4 Firearm Cancellations
Firearm orders remain subject to all applicable federal, state, and local laws.
Where California Penal Code section 26883 applies, a buyer who cancels a firearm purchase during the applicable California 10-day waiting period will not be charged a restocking or other return-related fee greater than 5% of the firearm’s purchase price, except as otherwise permitted by applicable law.
This limitation does not apply to a qualifying special-order firearm as provided by applicable law.
For purposes of California Penal Code section 26883, a special-order firearm generally means a firearm specifically requested by the buyer that was not otherwise available to the licensee.
Nothing in this policy is intended to impose a fee exceeding a limitation established by applicable law.
7. Returns and Refunds
7.1 Return Period
An eligible standard stocked product may be returned within 14 calendar days after confirmed delivery.
To qualify for a standard return, the product must be:
- Unused
- Uninstalled
- Unmodified
- In new and resalable condition
- Complete with all parts, accessories, manuals, labels, and other materials
- Returned in its undamaged original packaging
All returns require prior authorization.
A Return Merchandise Authorization (“RMA”) number must be issued before a product is returned. Unauthorized returns may be refused and will not be processed until appropriately authorized.
8. Refund Options for Eligible Non-Defective Returns
For an eligible non-defective return, the customer may select one of the following options:
Refund to Original Payment Method
A 50% restocking fee will be deducted from the product purchase price.
Store Credit
A 15% restocking fee will be deducted from the product purchase price, and the remaining eligible amount will be issued as store credit.
Store credit:
- Is not redeemable for cash
- Has no cash value except where required by law
- May only be used toward eligible future purchases from The Gun Co.
Original shipping, handling, insurance, processing, transfer, government, and other service fees are not refundable except where required by law or where the charge resulted from an error by The Gun Co.
The customer is responsible for return shipping and appropriate insurance for a non-defective return.
9. Defective, Damaged, or Incorrect Products
Cancellation and restocking fees do not apply when an approved return results from:
- A product that was defective when received
- A product damaged during shipment
- Receipt of a product different from the product ordered
- An error made by The Gun Co.
The customer must notify The Gun Co. within 14 calendar days after confirmed delivery and provide reasonably requested information, photographs, packaging photographs, serial or lot information, or other documentation needed to evaluate the claim.
If the claim is approved, The Gun Co. will provide return instructions and may, as applicable, provide:
- A replacement
- Repair
- Store credit
- Refund
The Gun Co. will pay reasonable return-shipping costs for an approved claim resulting from a defective product, shipping damage, an incorrect item, or an error by The Gun Co.
Manufacturer warranty coverage may apply after The Gun Co.’s 14-day return period. Manufacturer warranty claims remain subject to the applicable manufacturer’s warranty terms and procedures.
10. Opened, Installed, Used, Modified, Incomplete, or Damaged Products
Products that have been installed, used, altered, modified, damaged after delivery, or returned with missing components, missing labels, damaged packaging, or other material deficiencies are not eligible for a standard return.
Installation or attempted installation by the customer, gunsmith, armorer, dealer, or another person does not by itself establish that a product is defective.
The Gun Co. may, but is not required to, approve an exception when a returned product can safely and lawfully be resold.
Any approved exception may be subject to a restocking fee of up to 50% of the product purchase price, depending upon the product’s:
- Condition
- Completeness
- Packaging
- Inspection requirements
- Repackaging or reconditioning requirements
- Reduction in resale value
11. Nonreturnable and Final-Sale Products
Except where otherwise required by law or where an approved claim results from a defective product, shipping damage, an incorrect item, or an error by The Gun Co., the following are final sale and cannot be canceled, returned, exchanged, or refunded:
- Ammunition
- Custom products
- Custom firearm builds
- Special-order products
- Limited-production products designated as final sale
- Products altered, engraved, coated, assembled, machined, or manufactured according to customer instructions
- Clearance products
- Products expressly marked “Final Sale”
- Used or installed products
- Modified products
- Products missing required parts, packaging, serial-number labels, documentation, or other original materials
- Firearms or serialized products after transfer to the customer, except where otherwise required by law
A product-specific cancellation or final-sale notice displayed on a product page, quote, invoice, shopping cart, checkout page, or order confirmation is incorporated into these Terms.
12. Return Authorization Process
Before returning an eligible product:
- Email info@thegunco.com.
- Provide your full name and order number.
- Identify the product and quantity you wish to return.
- State the reason for the return.
- Provide photographs or other requested information when applicable.
- Wait for an RMA number and return instructions.
- Clearly display the RMA number on the shipping label or outer package as instructed.
- Include a copy of your invoice or order confirmation if requested.
- Package the product securely.
- Use a trackable and appropriately insured shipping method.
Unless The Gun Co. provides a prepaid shipping label or different instructions, authorized returns should be sent to:

The Gun Co. is not responsible for loss or damage to an unauthorized return or a return shipment sent without adequate tracking, packaging, or insurance.
13. Return Inspection and Refund Processing
All returned products are subject to inspection before a refund or store credit is approved.
Please allow approximately five to seven business days after the authorized return is delivered for inspection and processing.
Approved refunds will be issued to the original payment method unless another refund method is required by law or expressly agreed upon.
Financial institutions and payment processors may require additional time to post a completed refund.
If a returned product does not satisfy the applicable return requirements, The Gun Co. may reject the return.
The customer will be responsible for reasonable costs associated with shipping a rejected return back to the customer.
14. Exchanges
The Gun Co. does not process direct exchanges.
A customer who wants a different eligible product must place a new order and separately request authorization to return the original product under the applicable return policy.
15. Shipping and Delivery
Shipping dates and delivery estimates are estimates only unless expressly guaranteed in writing.
The Gun Co. is not responsible for delays caused by carriers, weather, government action, regulatory review, firearm-transfer requirements, natural disasters, supply-chain interruptions, incorrect customer information, or circumstances outside our reasonable control.
Customers are responsible for providing accurate shipping, contact, and FFL information where applicable.
Additional charges caused by an incorrect address, failed delivery, refused shipment, incorrect FFL information, or customer-requested rerouting may be charged to the customer to the extent permitted by law.
16. Firearm Transfers
A firearm order may require transfer through an appropriately licensed FFL.
The customer is responsible for:
- Selecting an eligible receiving FFL
- Confirming that the receiving FFL is willing to accept the firearm
- Complying with all applicable identification, age, background-check, waiting-period, residency, eligibility, and other legal requirements
- Paying applicable transfer or government fees
Firearms will only be delivered or transferred when all applicable federal, state, and local eligibility, age, background-check, waiting-period, residency, dealer, and other legal requirements have been satisfied.
The Gun Co. does not guarantee that a customer will successfully complete a required background check or firearm transfer.
A firearm that cannot legally be transferred may be subject to the applicable cancellation, return, special-order, shipping, and restocking provisions of these Terms, subject always to applicable law.
17. Warranties
Products manufactured by third parties may be covered by warranties provided by their respective manufacturers.
Products manufactured by The Gun Co. are subject to any written warranty provided with the applicable product or published separately by The Gun Co.
Except to the extent expressly provided in a written warranty or required by applicable law, The Gun Co. does not make additional warranties regarding products manufactured by third parties.
Installation, alteration, misuse, unauthorized modification, or use with incompatible products or components may affect applicable warranty coverage, subject to the terms of the applicable written warranty and applicable law.
Nothing in these Terms excludes, limits, or disclaims a warranty or consumer right that cannot lawfully be excluded or limited.
18. Assumption of Responsibility
Firearms and firearm components are inherently capable of causing serious injury or death if improperly installed, maintained, stored, handled, or used.
The purchaser and user are responsible for:
- Proper installation
- Appropriate inspection
- Confirming firearm compatibility
- Following manufacturer instructions
- Using appropriate ammunition
- Maintaining the firearm and components
- Following accepted firearm-safety practices
- Complying with applicable laws
The Gun Co. is not responsible for injury, property damage, malfunction, or loss caused by misuse, abuse, negligent handling, unlawful use, improper installation, unauthorized modification, use with incompatible components, or failure to follow applicable instructions, except to the extent liability cannot lawfully be excluded.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE GUN CO. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR MISUSE OF THE SITE OR PRODUCTS SOLD THROUGH THE SITE.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited, including any rights or remedies provided by applicable consumer-protection or product-liability law.
Statements made by employees, representatives, dealers, installers, or other persons do not modify an express written warranty or these Terms unless the modification is expressly authorized in writing by The Gun Co.
20. Intellectual Property
The content of the Site, including text, photographs, graphics, logos, product imagery, videos, designs, layout, branding, software, and other materials, is owned by or licensed to The Gun Co. and may be protected by copyright, trademark, trade dress, patent, and other intellectual-property laws.
You may access Site content for your personal, noncommercial use.
Except as permitted by applicable law or with prior written authorization from The Gun Co., Site content may not be copied, reproduced, republished, distributed, modified, displayed, sold, licensed, used commercially, or used to create derivative materials.
Nothing in these Terms grants any license or right to use The Gun Co.’s trademarks, logos, trade names, product names, or branding.
21. Third-Party Links and Services
The Site may contain links to websites, services, applications, payment processors, manufacturers, carriers, dealers, or other third parties.
Third-party services are governed by their own terms and privacy practices.
The Gun Co. does not control and is not responsible for third-party websites, content, products, policies, security, or services solely because a link to them appears on our Site.
22. Privacy
Our collection, use, retention, disclosure, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Please review the Privacy Policy before providing personal information through the Site.
23. Policy Disclosure and Acceptance
The cancellation, return, refund, final-sale, and restocking provisions in these Terms form part of the agreement between the customer and The Gun Co.
Applicable restrictions, final-sale classifications, fees, product-specific conditions, and other material terms may also be displayed on:
- Product pages
- Quotes
- Invoices
- Shopping carts
- Checkout pages
- Order confirmations
By submitting an order, the customer acknowledges that the customer was provided an opportunity to review the terms applicable to the transaction, including applicable cancellation, final-sale, return, and restocking-fee provisions.
24. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent another jurisdiction’s nonwaivable law applies.
Nothing in this section eliminates any legal right or remedy that cannot be waived by agreement.
25. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
26. No Waiver
Failure by The Gun Co. to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
